When the attorney
originally procured the weather records, he had
examined them on his own, and neglected to seek
a meteorological interpretation. He had been so
convinced that the weather records would support
his client’s position that no attempt whatsoever
had been made to settle. Now four years later
with trial only two weeks off, this was the first
time that the attorney had received any input
from a meteorologist about the weather
conditions at the time of loss! Perhaps a bit
late with both sides steaming into battle "full-speed
ahead".
At the time that
he ordered the records, the attorney had requested
"weather records for the closest site to
the loss". The closest site was a cooperative
reporting station, which only reported daily
conditions (with a "day" ending at 7
AM)! However, hourly observations were necessary
to pinpoint the weather conditions at the time
of loss. The observations from all nearby hourly
and cooperative observation sites were obtained
from Compu-Weather’s extensive in-house
library. Upon reviewing the records, Compu-Weather’s
meteorologists were put in the uncomfortable position
of informing the attorney that the weather conditions
would actually hurt his case instead of
supporting it. Needless to say, with this new
information, his client’s position was weakened
to the point of having no case at all, and the
settlement which was later reached was far from
favorable.
Unfortunately,
this client had failed to utilize Compu-Weather’s
expert meteorological interpretation included
at no extra charge with every order. He had
procured "weather records for the closest
site" because he thought it would serve his
purpose. However, as "co-ops" (as they’re
called) don’t report by the hour, they’re often
not very useful for identifying conditions at
the actual time of loss. Compu-Weather’s

meteorological data in order to determine and
confirm precise weather conditions within a reasonable
degree of meteorological certainty.
Moral of the story:
Don’t go it alone! Increase the probability of
